PastUntold Terms of Service

These Terms are a binding agreement between you and Tucido for your use of the PastUntold mobile app and the websites pastuntold.app and pastuntold.com (together, the "Service").

1. Acceptance

PastUntold is operated by Tucido ("Tucido", "we", "us"). By creating an account or using the Service, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility and accounts

• You must be at least 18 years old.
• You sign in through Google, Apple or Facebook. You are responsible for keeping that account and your device secure.
• You are responsible for all activity under your account. Do not share or transfer it.
• Tell us promptly at support@tucido.com if you suspect unauthorised use.

3. Licence

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial entertainment and learning. All other rights are reserved.

4. Acceptable use

You agree not to:

• Copy, record, download, redistribute or publicly show our content, except through sharing features we provide
• Use our content to train or develop any artificial intelligence or machine learning model
• Scrape the Service or access it with bots or other automated means
• Reverse engineer, decompile or modify the app, except where the law allows
• Bypass paywalls, security or technical limits, or exploit bugs to obtain coins, items or access
• Sell, trade or transfer accounts, coins or virtual items
• Interfere with the Service or use it for anything unlawful

5. Our content and AI

PastUntold episodes are dramatisations of historical events, made for entertainment and general learning. They are created with the help of artificial intelligence tools, including for scripts, images, video and voice.

• Episodes may simplify events, compress timelines, and include invented dialogue, composite characters and imagined visuals.
• Depictions of real people are artistic interpretations, not actual likenesses or recordings.
• History is open to interpretation and debate. Content may contain errors or omissions.
• Do not rely on PastUntold as an academic, professional or authoritative source. Verify anything important independently.

6. Intellectual property

The Service and all its content, including episodes, scripts, images, audio, quizzes, software, the PastUntold name and logos, belong to Tucido or its licensors. Using AI tools to create content does not waive our rights in it. These Terms give you no ownership of any of it.

If you believe content on the Service infringes your rights, email support@tucido.com with details and we will review it.

7. Feedback

If you send us ideas or suggestions, we may use them freely, without restriction or payment.

8. Purchases

Payment. Purchases are processed by the Apple App Store or Google Play under their own terms. Prices are shown before you buy and may change.

Subscriptions. Subscriptions renew automatically at the end of each billing period, at the then-current price, until you cancel. To avoid the next charge, cancel at least 24 hours before the period ends, in your App Store or Google Play subscription settings. Deleting the app or your account does not cancel a subscription. Access continues until the end of the period you paid for.

Coins and virtual items. Coins and virtual items, whether bought or earned, are a limited licence to use features in the Service. They have no cash value, are not your property, and cannot be sold, transferred or exchanged for money. We may change their price, availability or use, and unused balances are lost when your account is closed.

Refunds. All purchases are final and non-refundable, except where the law or the app store's policy requires otherwise. Refund requests are handled by Apple or Google.

Right of withdrawal. If you live in the EU or UK, you may have a 14-day right to withdraw from a digital purchase. By buying, you ask us to supply the digital content immediately and accept that you lose this right once supply begins.

Ads. The Service may show advertising, including rewarded ads. We are not responsible for advertisers' products or services.

Nothing in this section limits consumer rights that cannot be waived under the law that applies to you.

9. Changes to the Service

We may add, change or remove content and features, or suspend or end the Service, at any time. The Service may be unavailable from time to time.

10. Suspension and termination

You may stop using the Service and delete your account at any time in Settings. We may suspend or close your account if you breach these Terms, for fraud or security reasons, or where the law requires. On termination your licence ends and your progress, coins and virtual items are lost.

11. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise that the Service will be uninterrupted, error-free or secure.

12. Limitation of liability

To the fullest extent the law allows, Tucido and its founders, officers, employees and partners are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill.

Our total liability for any claim is limited to the greater of (a) the amount you paid us in the 12 months before the claim and (b) US$50.

Nothing in these Terms excludes liability that cannot be excluded by law.

13. Indemnity

You agree to compensate us for losses and costs arising from your breach of these Terms or your misuse of the Service.

14. Third-party services and app stores

The Service relies on third parties such as Apple, Google and Facebook, whose own terms apply to their services. Apple and Google are not parties to these Terms, are not responsible for the Service or its support, and may enforce these Terms against you as third-party beneficiaries.

15. Governing law and disputes

Please contact us first at support@tucido.com; we will try to resolve any dispute informally within 30 days.

These Terms are governed by the laws of the State of Israel, without regard to conflict-of-law rules. The competent courts of Tel Aviv-Jaffa, Israel have exclusive jurisdiction. If you are a consumer, you keep any mandatory protections and court rights of the country where you live.

16. General

• Changes to these Terms. We may update these Terms. We will change the "Last updated" date and, for material changes, notify you in the app or by email. Continued use means you accept the updated Terms.
• Transfer. We may transfer these Terms, including to a company we form or to a successor. You may not transfer your rights.
• Severability. If any part of these Terms is unenforceable, the rest remains in effect.
• Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and us about the Service.
